I believe that the landmark United Biscuits v H.M Customs and Excise case back in 1991 had established that they where legally considered to be a cake ? I think H.M customs subsequently appealed and won, and they where then considered to be biscuits, but then I think it went back to court again, and the deciion overturned. ****** if I know really
