For the most part, this is mainly an arguement to get up the noses of the not-so-wonderful HMRC;

evidently trading using Spread Betting is classified as gambling because you are taking a rolling bet on a daily basis.

However, I trade CFDs with all positions closed out before the close of the market, hence essentially not having the opportunity to benefit from corporate actions and dividends etc, therefore, I'm toying with the idea of having a punt at argueing that in essence I'm technically speaking; "gambling"... likely doomed to failure, but food for thought nonetheless!
